Agreement to Terms

Welcome to StatFlow. These Terms of Service ("Terms") govern your access to and use of the StatFlow mobile application and website (collectively, the "Services"), operated by Jasmind Digital ("we," "our," or "us"), located in Montreal, Quebec, Canada.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

Eligibility

You must be at least 13 years old to use StatFlow. By using our Services, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use our Services.

Account Registration

To access certain features, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You may create multiple accounts if desired, but each account must comply with these Terms.

Analytics and Monitoring

We monitor usage of our Services through analytics tools, including Firebase Analytics, to improve reliability, performance, and features. This monitoring is conducted in aggregated form and is not used to track individual user behavior manually.

Analytics data helps us understand which features are most valuable, identify technical issues, and make informed decisions about product improvements. For more details about our data collection practices, please review our Privacy Policy.

Subscription and Payment Terms

Premium Subscriptions

StatFlow offers premium subscription features. By subscribing, you agree to the following:

• Payment Processing: All payments are processed through RevenueCat and your device's native payment system (Google Play Store or Apple App Store).
• Subscription Plans: Subscriptions are available on a monthly or annual basis at the prices displayed in the app.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• Cancellation: You may cancel your subscription at any time through your device's subscription settings. Cancellation takes effect at the end of the current billing period.
• No Refunds: We do not provide refunds for partial subscription periods. If you cancel, you retain access to premium features until the end of your current billing period.
• Price Changes: We reserve the right to change subscription prices with advance notice. Price changes will not affect your current billing period.

User Content and Data Ownership

Your Data: You retain ownership of all sports statistics, training data, and other content you create or input into StatFlow ("User Content"). By using our Services, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing our Services to you.

Our Use of Data: We may use anonymized, aggregated data derived from User Content to improve our Services, develop new features, and analyze usage patterns. This anonymized data cannot be used to identify individual users.

Data Accuracy: You are solely responsible for the accuracy of all statistics and data you enter into StatFlow. We do not verify, validate, or guarantee the accuracy of any User Content.

Data Visibility and Sharing: You control what data you make public or shared with other users. When team and league features become available, coaches and administrators may see player data they manage. You are responsible for understanding the visibility settings of any data you input or share.

Data Export: Data export functionality is not currently available but may be added in future updates.

Service Modifications and Analytics Evolution

We reserve the right to modify, update, or discontinue any aspect of the Services at any time without prior notice. This includes but is not limited to:

• Features and functionality
• Analytics algorithms and statistical calculations
• Data models and performance insights
• User interface and experience
• Pricing and subscription tiers

Analytics Volatility: Statistical calculations, advanced metrics, and performance insights may evolve over time as we improve our algorithms. Historical analytics may be recalculated or updated retroactively. We make no guarantee that analytics methods will remain constant.

No Reliance on Insights

Informational Purposes Only: All analytics, insights, statistics, and performance metrics provided by StatFlow are for informational and tracking purposes only. They do not constitute professional coaching, medical, health, fitness, or career advice.

User Responsibility: You should not rely on StatFlow's analytics or insights for decisions affecting your health, safety, athletic career, or wellbeing. Always consult with qualified professionals (coaches, trainers, physicians, sports medicine specialists) before making decisions based on data from our Services.

No Guarantees: We make no representations or warranties about the accuracy, completeness, or reliability of any analytics or insights provided by the Services.

User Responsibilities for Shared Data

When team and league features become available:

• Data Visibility: You are responsible for understanding and managing what data you make visible to coaches, team administrators, or league organizers.
• Administrator Responsibilities: Team captains, coaches, and league administrators are responsible for data they enter on behalf of players and for obtaining appropriate consent from players.
• Misuse of Shared Data: We are not responsible for how other users (coaches, administrators, teammates) use, share, or interpret shared statistics and data.
• User-to-User Disputes: We do not mediate disputes between users regarding data accuracy, access rights, or any conflicts arising from shared statistics. Such disputes are between the users involved.

Acceptable Use

You agree not to:

• Use the Services for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Upload or transmit viruses, malware, or other malicious code
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the Services or servers
• Use automated systems (bots, scripts) to access the Services
• Reverse engineer, decompile, or disassemble any part of the Services
• Remove or modify any proprietary notices or labels
• Use the Services to compete with us or create a similar service

Termination

By You: You may terminate your account at any time by deleting your account through the app settings. Upon termination, all your data will be permanently deleted from our servers.

By Us: We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to violation of these Terms. We may terminate accounts without prior notice. Upon termination by us, your data will be deleted in accordance with our Privacy Policy.

Disclaimers

NO WARRANTIES: THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Data Accuracy: StatFlow is a tracking tool. We do not verify the accuracy of statistics you enter. You are solely responsible for ensuring the accuracy of your data.

No Medical or Fitness Advice: StatFlow does not provide medical, health, or fitness advice. The Services are for informational and tracking purposes only. Always consult with qualified professionals before beginning any fitness or training program.

No Coaching or Professional Advice: Analytics and insights provided by StatFlow do not constitute professional coaching, sports science, or career guidance. We are not responsible for decisions you make based on data from our Services.

Service Availability: We do not guarantee that the Services will be uninterrupted, secure, or error-free. We are not liable for any loss of data, service interruptions, or technical issues.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JASMIND DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100 CAD), WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless Jasmind Digital and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, your violation of these Terms, or your violation of any rights of another user.

Dispute Resolution

Governing Law: These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

User-to-User Disputes: We do not mediate or resolve disputes between users regarding statistics accuracy, data access, team management, or any other conflicts arising from use of shared features. You agree that such disputes are solely between the users involved, and we have no obligation to intervene.

Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Services (between you and Jasmind Digital) shall be resolved through binding arbitration in accordance with the arbitration rules of the Province of Quebec. The arbitration shall take place in Montreal, Quebec, and shall be conducted in English or French at your choice.

No Class Actions: You agree that any arbitration or proceeding shall be limited to the dispute between you and Jasmind Digital individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Intellectual Property

StatFlow and all related trademarks, logos, and service marks are the property of Jasmind Digital. The Services, including all software, text, images, and other content, are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Services without our express written permission.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and notify you through an in-app notification. Your continued use of the Services after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services and delete your account.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jasmind Digital regarding the Services and supersede all prior agreements and understandings.
